Nurse Marešová will receive 2.27 million crowns from the state for prosecution

However, all the trials that happened brought back what I wanted to forget a long time ago. But I’m glad it turned out that way,” he said. His lawyer Iva Jónová added that together they would consider filing an appeal.

The Ministry of Justice previously voluntarily paid Marešová one million crowns for the illegal prosecution. Today, the Prague City Court handled the state appeal, which disagreed that he should pay the woman an additional 1.57 million according to the district court’s decision. The state appeals panel complied only partially, reducing compensation by 300,000 crowns. However, the ministry will also have to pay Marešová litigation fees as well as interest, which his lawyer estimates are another half a million crowns.

In its appeal, the Office of the State Representative in Property Affairs seeks to overturn the ruling and return the matter for further consideration, or even to reduce the amount. He questioned the impact the prosecution had on Marešová’s personal life. “If he wanted to remain anonymous in Prague, he would not personally attend all of the court proceedings, which is also against the media,” office employees pointed out in court.

The civil court awarded Mare about 850,000 crowns for damages to health, according to expert opinion. He will receive the remaining money for non-pecuniary damages caused by criminal prosecution. “It is clear that what the plaintiffs suffered cannot be compensated for with any amount of money,” said Pavel Freibert, a member of the appeals panel. “The impact on the plaintiff’s life was quite basic, he had to change his place of residence and occupation. It also had a significant impact on his family’s life.”

However, according to him, the initial number of circuit courts was too high. The appeals panel agreed that the woman was entitled to a thousand crowns for each day her prosecution took place. The district court previously held that the criminal proceedings damaged Marešová’s reputation and made it difficult for him to work in his field for life. The considerable media coverage of the case also contributed to this.

The prosecution claims that between 2010 and 2014, Marešová administered strong doses of potassium to patients at the Rumbur hospital, after which their hearts failed. He allegedly wanted to make his job easier. The investigation began with the death of one of the patients. In the summer of 2014, police first accused Marešová of this murder, and then, based on expert opinion, five more. The public prosecutor demanded a life sentence for the woman. But the court acquitted him because it was not proven that the action occurred.

Marešová also criticized the role played by the media in his case. He pointed out that journalists do not respect the presumption of innocence. He filed lawsuits against several media companies, demanding millions in compensation. He recovered CZK 1.2 million from TV Nova, CZK 900,000 from publisher Blesk i Aha – media house CNC, CZK 700,000 from publisher Mafra, and CZK 250,000 from Vltava Labe Media. He concluded an out-of-court agreement with publisher Economia, the parties did not disclose its form. In a dispute with Prima television, the trial will resume in May.

The Ministry of Justice stated today that, according to its statistics, the record for compensation for criminal prosecution remains about five million crowns, which was paid to a man from Hlinsko who was illegally convicted of raping a girl. His innocence was revealed only after 18 years in a new criminal trial.

However, according to the office, the amount of individual compensation for prosecution cannot be compared. “Every injured party has the right to claim compensation that can be proven by the amount and causal relationship with criminal prosecution. One can claim compensation for lost income, one’s compensation for non-pecuniary damages, one’s expenses incurred for legal representation, or any combination of these, or even a claim that is defined differently,” the ministry said last year, in connection with the proceedings. criminally, he paid compensation in the total amount of about 73.25 million crowns, both voluntarily and by court decision.
