The 13th year of the traditional conference called “Investment Treaty Arbitration Conference” organized by the Ministry of Finance took place on October 26 in the representative building of the Liechtenstein Government Office Palace. This conference is a prestigious international forum for the exchange of experience in resolving investment disputes between countries and foreign investors.
“For us, the greatest benefit of this conference is the exchange of proven experience with representatives of other countries that have defense against investment claims. The annual meeting, which is also attended by representatives of the academic community and the private sector, helps us defend the interests of the Czech Republic in international investment arbitration, where we have long been one of the most successful countries in the world.” said Martina Matejová, senior director of legal affairs at the Ministry of Finance. “I am pleased that our conferences continually attract experts from all over the world. More than 150 participants from 27 countries, among them 39 colleagues from civil service ranks representing their countries in investment arbitrations from 14 countries, took part in this year’s edition. said Jaroslav Kudrna, head of the separate departments of International Arbitration and Foreign Investment Protection.
The main speaker of the conference was a professor George Berman, director of the Center for International Trade and Investment Arbitration at Columbia University in New York. The morning section was marked by an expert panel on investor obligations arising from international investment treaties and the issue of judicial expropriation of investments. The afternoon event then consisted of panel discussions on current topics regarding the code of ethics of arbitrators sitting in arbitration tribunals and possible future developments in investment arbitration. The run-up to the conference itself, in collaboration with ICC YAAF and Young ITA, is classically dedicated to the young generation of lawyers dealing with international dispute resolution, who can gather valuable advice from more experienced foreign colleagues and at the same time discuss environmental aspects. international investment protection.
The day after the conference, a seminar was held for country representatives which was attended by representatives from more than 14 countries, led by speakers from Argentina and Latvia. The main subject is a discussion regarding state defense in investment arbitration, as well as a simulation of negotiating certain provisions in international investment agreements.
