The doctors of the Central Military Hospital committed no crime when they diagnosed President Miloš Zeman with a serious disease of the digestive system. This is decided by the public prosecutor. The criminal suit was filed by Zeman’s attorney, Marek Nespala. However, his claims of falsified medical reports did not hold up. Based on the conclusions of the doctors, an open discussion is whether the president should be temporarily removed from power.
On October 18 last year, Senate President Miloš Vystrčil received a letter from the director of the Central Military Hospital, Miroslav Zavoral, about the state of President Miloš Zeman’s health. At that time, the head of state was hospitalized for a second week due to ascites and encephalopathy accompanying symptoms of liver cirrhosis. The president is in very serious condition.
“Due to the nature of the illness, the long-term prognosis of President Miloš Zeman’s health is judged to be highly uncertain, and thus the possibility of returning to work in the coming weeks is judged unlikely,” Vystrčil quoted the letter as saying. He then started a debate in the Senate about whether to temporarily remove Zeman’s competence.
Less than three weeks later, Tomáš Zima, chairman of the independent medical board, which also examined the president’s condition in detail, came to the same conclusion. According to the recent conclusions of the District Prosecutor’s Office for Prague 6, the medical report is in full compliance with the law.
The medical report is correct
“No facts were found that indicate, not even a suspicion, that the exposed medical reports were highly distorted or important facts were hidden in them, as they were based on expert examinations and tests,” said Aleš Cimbala, a spokesman for Prague. prosecutor.
The plaintiffs thus refuted the suspicions of Zeman’s lawyer Marko Nespala that there had been forgery and publication of false medical reports, reports and findings. The public prosecutor also examined whether the information provided by hospital director Miroslav Zavoral in the letter to the President of the Senate as well as to the head of the presidential office, Vratislav Mynář, was criminal.
He concluded that the letters were not medical certificates from the point of view of criminal law, so there was no offense at all. In contrast, the public prosecutor argued that Zavoral’s letter to Vystril was merely a blessing, which should, at the last resort, form the basis for a parliamentary decision whether to temporarily remove Zeman’s powers.
“Just like ordinary ‘disability’, even this temporary measure will be canceled when the state of health improves. Therefore, even for the reasons mentioned, it is not possible to view informal records as medical reports, opinions or findings, as they are. background information serves only for an informed decision on the activation of the procedures enshrined in the Czech Republic’s Constitution,” said a spokesperson for Cimbala.
Application to the Attorney General’s Office

In this way, he informed that Zeman’s lawyer, Marek Nespala, petitioned the Attorney General’s Office to examine whether the actions described above did not result in a criminal act of sabotage. Attorney General Igor Stříž handed over the initiative to the chief prosecutor in Prague, Lenka Bradáčová, whose office denied suspicions of sabotage in August.
“However, regarding the facts claimed by the complainant, the submission was forwarded for evaluation and possible action to the Prague District Prosecutor’s Office 6, with respect to the offense of forgery and issuing false medical reports, opinions and findings,” the head of the Department of Serious Economic and Financial Crimes Marek Bodlák .
The office of the chief prosecutor of Prague 6, Richard Petrásek, has now confirmed that there was no falsification of medical reports. Zeman’s lawyer, Nespala, only responded with a general statement. “At this point, it is too early to communicate a conclusion. As soon as there is more room, we will look into it. The president will carefully consider all options allowed by the legal order,” he told Aktuálně.cz.
Seven weeks in hospital
President Zeman spent a total of seven weeks at the Central Military Hospital, he was released from hospitalization on November 25. More than half of this time is spent in anesthesia, resuscitation, and intensive care clinics. On November 4, his condition improved so doctors transferred him to a standard room.
Thanks to the positive development of Zeman’s condition, only the debate about the temporary abolition of his powers remains. The Senate or one of its committees never voted. The resignation of Andrej Babi’s government after the parliamentary election is still being accepted by the presidential office, as Zeman was still in hospital at the time. On November 28, Zeman personally appointed Petr Fiala as prime minister.
