McDonald’s, Nuggets | Charged after McNugget’s bad injury: – He screamed at the top of his lungs

A pair of parents are now suing the fast food chain McDonald’s and are seeking compensation of over NOK 150,000. The reason is the glowing chicken nuggets.

The incident, which has now reached a courtroom, took place at a McDonald’s restaurant in the town of Tamarac in 2019, which is operated by food franchise operator Upchurch.

Philana Holmes and her four year old daughter were going to a restaurant for a quick meal. At the drive-through hatch, mother and daughter ordered something to eat before the food was delivered to the car.

The mother sent a Happy Meal box to her daughter’s backseat before moving on. Then heard something from the backseat:

– He shouted at the top of his lungs, the mother explained to the court, according to the newspapers Guardian of the Sun.

There, the four-year-old girl lost one of the chunks, pinning it between her thigh and the seat belt, according to the mother.

Holmes’ attorneys later claimed in court that the fried chicken piece had a temperature of 93 degrees and the girl suffered second-degree burns to her thighs.

– Unnatural heat

According to lawyers, the four-year-old then ended up with a large scar where the piece of chicken landed.

– The chicken nuggets, which were in the Happy Meal box, were too hot. It caused burns to the girl’s thighs, the lawsuit said.

The girl’s father, Humberto Carballo Estevez, explained to the court that his daughter still has a visible scar on her thigh. She explains that the scar no longer bothers her daughter, but she sometimes refers to it as “her own nugget”.

In a statement to Guardian of the Sun McDonald’s said the following about the incident:

– This case has been thoroughly investigated. Ensuring high standards of food safety and quality requires strict guidelines and procedures for every product we prepare and serve. These guidelines and procedures were followed in this case. We therefore respectfully disagree with the plaintiff’s claim, the statement said.

Not the first time

This is not the first time the world’s largest fast food chain has been taken to court for serving products that were too hot to its customers. In 1994, a 79-year-old woman sued McDonald’s after she spilled coffee on her lap and suffered third-degree burns.

The court ruled that McDonald’s had sold the woman too hot coffee and she walked away victorious with $2.8 million in her pocket. The case was appealed and the amount reduced, but in the end the parties reached an agreement on an unknown amount.
