Prosecutors reject President Zeman’s suspicions of sabotage during hospitalization

“The submission is evaluated in such a way that there is no suspicion of committing a criminal act of sabotage in the given case. However, based on the facts claimed by the complainant, the application is forwarded for evaluation and possible action to the Prague 6 District Prosecutor, in relation to the crime of falsifying and issuing false medical reports, reports and findings,” said the prosecutor. When asked if he knew about the initiative’s findings regarding unjustified sabotage, Castle’s legal representative, Marek Nespala, replied that “this information leak from the High Prosecutor’s Office is not entirely accurate”. Prosecutors in Prague will investigate Zeman’s suggestion of possible sabotage during hospitalization

Zeman handed over the initiative to Justice Minister Pavlo Blažek at the end of June. He later stated that he did not have the authority to review the initiative, so he would hand it over to the attorney general.

In the petition, the President stated that, as the directly elected head of state, he was forced to face attempts to usurp his power. According to him, the sabotage could have happened in September or November last year.

“From the very beginning, it was a matter of false information about the actual state of health of the President of the Republic, which ultimately started the process by which the most important representatives of the sovereign people had to be stripped of their constitutional powers, thereby undermining the constitution of the Czech Republic, because of the abuse of office of the people of the Republic of Indonesia. the ranks of doctors, some senators, and even the academic community,” said presidential spokesman Jiří Ovčáček earlier.

At the time, Nespala would not comment on whether the initiative mentioned anyone specifically.

President of Senator 21 and club Pirátů Václav Láska said in response on Wednesday that prosecutors ruled as everyone in the court had hoped “except for Nespala’s lawyer, who was paid to think otherwise”.

“The fact that the president calls the interests of constitutional and public officials in the state of his health in relation to the performance of the presidency as sabotage may seem childish to me. And if we live in a free country, I don’t expect a different verdict,” Senator Jan Hornik said.

Hospitalization in VN

On October 10 last year, the day after the parliamentary elections, Zeman was transferred to the intensive care clinic of the Prague Military Central Hospital (ÚVN). According to the doctor’s report, which was later received from VN and published by the head of the Senate, Miloš Vystrčil, Zeman was unable to perform his job duties at that time.

In addition, the long-term prognosis of his health condition was highly uncertain, doctors said at the time. Therefore, several senators and deputies have begun to consider temporarily transferring some of the President’s powers to the Chair of the DPR and the Government, in accordance with Article 66 of the Constitution. Some also criticized the way the castle office reported Zeman’s hospitalization and health status.

In an interview for MF DNES in mid-February, Zeman called the attempt to transfer power an attempted coup. In response, Vystril said he acted as directed by the constitution and as president of the Senate should act if the public did not have information about the health of the highest constitutional official to which he was entitled.

After Zeman filed a complaint with the prosecutor’s office, Vystrčil described it as “almost stupid” because, in his opinion, it led to something that didn’t happen.

Forty-eight days in the hospital

Zeman was hospitalized on October 10, 2021. Around noon, an ambulance left Lán castle with him, shortly after the departure of Prime Minister Andrej Babi, who had previously met with the head of state for a nearly hour-long meeting. According to Castle, the president had been sick in the previous two weeks, because of which he voted in direct elections in Lány. He was hospitalized at the Central Military Hospital (ÚVN) intensive care clinic.

Miroslav Zavoral, doctor and director of VN Zeman, later said that the reason the president was hospitalized was the complications that accompanied his chronic illness. He did not reveal the president’s exact diagnosis to the media, as he did not have the consent to do so.

Doubts about the actual health condition of the president then arose in the public sphere. The head of the Senate, Vystril, on behalf of the upper house Organizational Committee, requested information from Chancellor Vratislav Mynář about Zeman’s health condition. The media reported that the president’s condition was more serious than those around him had reported.

He pushed out a few days later and announced that he doubted whether the president knew how the presidential office had informed him and the state of his health. On October 18, the head of the Senate published a report from VN, which stated that Zeman was unable to perform any job duties due to health reasons. Vystrčil also states that the long-term forecast is highly uncertain according to VN.

The next day, the police announced that they would open an investigation into possible illegal acts, in which signs of crimes against the republic could be seen. The then Prime Minister Andrej Babi then asked Mynář to resign, saying that if he did not do so, he was prepared to remove him following the activation of article 66 of the constitution on the division of powers of the head of state. Mynář says that the only one who can remember him is Zeman.

Parliamentary party leaders later agreed that both chambers of parliament would seek another report from the National Assembly on whether Zeman could continue to serve as head of state before any decision on the transfer of presidential powers.

Zeman’s condition began to improve, his predecessor in the office of Václav Klaus and public rights defender Stanislav Křeček visited him in hospital. On November 4, Zeman was transferred to a standard inpatient ward, then on November 15 to a long-term care bed. While still in hospital, Zeman entrusted ODS chairman and current prime minister, Petr Fiala, to form a new government and accept the resignation of Prime Minister Babi’s government.

On November 25, Zeman left VN, where he spent 46 nights, and headed for an ambulance to Lán. The military hospital said it continued to recommend the president receive treatment at a specialized medical facility. In the afternoon, an ambulance from Lán took Zeman back to VN, as the president tested positive for the coronavirus. However, he returned to Lán a day later.
